Title: Setback requirement varience
Text: "2. Setbacks for New Wells . . . . The City Manager may grant a ten (10) percent variance to the Setback Requirement, if the Operator demonstrates such variance will allow for the effective consolidation of facilities to minimize surface impact and/or that there is no technology commercially available at a reasonable cost to conduct the proposed oil and gas operations in compliance with the provision and granting a variance from the operation of the provision will not have an adverse effect on the public health, safety or welfare or on the environment."
