Annotation: This 2017 agreement (aka MOU) follows a 2013 agreement between Broomfield and Sovereign Operating Company (see document CO173) which was supplemented in 2016 after Extraction became the successor-in-interest to Sovereign. Extraction is also the successor-in-interest to a surface use agreement between Broomfield and Noble Energy. This agreement was made to achieve the goals of Broomfield and Extraction to develop oil and gas in a cooperative manner, including adopting the best management practices set out in Exhibit B at the well sites set forth in Exhibit A.

Recommended:
Required: The Operator agrees to employ the BMPs on all New Wells and at all Well Sites." Page 3.
Ownership: Federal, State, and Private: The agreement applies to New Wells and Well Sites designated in Exhibit A of the agreement. While it is likely they are all private property, the MOU does not distinguish between types of surface or mineral ownership in application of the BMPs in the agreement.
